BUBO HEALTH TERMS OF SERVICE
Last Updated: May 9, 2026
Important: Bubo Health Is a Technology Company, Not a Healthcare Provider
Bubo Health is a technology company. We are not doctors, nurses, pharmacists, therapists, or any other type of licensed healthcare professional. No one at Bubo Health is acting in a clinical capacity, and no information, content, or feature within this app — including anything generated by artificial intelligence — constitutes medical advice, a medical diagnosis, or a recommended course of treatment.
Never rely on Bubo Health as a substitute for the judgment of a qualified medical professional. Always consult your physician, pharmacist, or other licensed provider before making any decision about your health, medications, or treatment. If you are experiencing a medical emergency, call 911 or your local emergency number immediately — do not use this app.
1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Bubo Health (“Bubo,” “we,” “our,” or “us”) governing your access to and use of the Bubo Health mobile application and related services (collectively, the “Services”). By creating an account, downloading the app, or using any part of the Services, you affirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the Services.
You must be at least 13 years of age to use Bubo Health. By using the Services, you represent that you meet this requirement. Users between 13 and 17 represent that they have obtained parental or guardian consent to use the Services.
2. Nature of the Services
The Services are designed as personal health management and organizational tools. They are intended to help you track, organize, and better understand your health information — not to diagnose illness, prescribe treatment, or replace the clinical judgment of your care team.
Bubo Health is not a medical device as defined by the U.S. Food and Drug Administration or any other regulatory body. It is not a telemedicine service and does not connect you with licensed clinicians for real-time consultations. No physician-patient relationship, pharmacist-patient relationship, fiduciary relationship, or any other professional clinical relationship is created by your use of the Services.
Nothing in the Services — including AI-generated content, medication information, lab result displays, nutrition analysis, symptom summaries, or any other output — should be treated as professional medical advice, a clinical diagnosis, or a substitute for consultation with a licensed healthcare provider. Always consult a qualified physician, pharmacist, or other licensed professional regarding any medical questions or before making any health-related decision.
3. Artificial Intelligence — Critical Disclaimers and Limitations
Read Before Using AI Features
Bubo Health uses third-party artificial intelligence services to power features including health chat, medication information, drug interaction checking, visit transcription, food analysis, and second-opinion tools. AI-generated health information may be inaccurate, incomplete, outdated, or inappropriate for your specific medical situation. You must not make medical decisions based solely on AI output from this app.
3.1 Specific AI Accuracy Limitations
- AI may be wrong about drug interactions. Drug interaction information is clinically complex, highly individualized, and constantly evolving. Any AI-generated drug interaction information must be verified with a licensed pharmacist or your prescribing physician before you act on it. Never adjust, add, or discontinue any medication based solely on information from this app.
- AI cannot know your full medical history. AI responses are generated based only on the limited context provided in a given session. The AI does not have access to your complete medical records, prior hospitalizations, genetic information, allergies you have not entered, or the nuanced clinical judgment of a provider who has examined and treated you over time.
- AI responses are not a substitute for your care team. Your physicians, nurses, pharmacists, and other licensed healthcare providers possess clinical training, licensure, direct patient interaction, and professional accountability that AI does not. No AI response from Bubo Health replaces or supplements your ongoing relationship with your care team.
- AI content may be outdated. AI models have training knowledge cutoff dates and may not reflect the most current clinical guidelines, drug approvals, safety warnings, or drug recalls.
- AI can generate plausible but incorrect information.Artificial intelligence systems can produce responses that sound authoritative but are factually wrong — a phenomenon sometimes called “hallucination.” This risk is especially significant in healthcare contexts, where precision and accuracy are critical to your safety.
- Context limitations affect quality. The quality and relevance of AI responses are limited by the completeness and accuracy of the health context you have entered in the app. Incomplete or inaccurate records will result in less useful or potentially misleading AI responses.
3.2 Your Obligation to Verify All AI Health Information
By using any AI feature within Bubo Health, you agree to treat all AI-generated health information as a starting point for further inquiry — not as a definitive clinical answer. You are required to verify all AI-generated health information with a licensed healthcare professional before taking any action based on it. This obligation applies to, but is not limited to: medication decisions, dosage adjustments, dietary changes, symptom interpretations, lab result explanations, and drug interaction assessments.
3.3 No Guarantee of AI Accuracy
Bubo Health makes no representations or warranties, express or implied, regarding the accuracy, completeness, timeliness, reliability, suitability, or safety of any AI-generated content. We expressly disclaim all liability for any decisions made in reliance on AI-generated content from the Services.
3.4 Third-Party AI Services
AI features within the app are powered by third-party AI service providers. These providers have their own terms of service and privacy policies that govern their operations. Bubo Health is not responsible for the output, availability, accuracy, or acts or omissions of any third-party AI service. For information on how data is shared with these providers, see our Privacy Policy.
3.5 Personal Identifying Information and Automated Scrubbing
Bubo Health's AI features process the inputs you provide — your messages, uploaded documents, photos, and recordings — through third-party AI service providers. To reduce the privacy risk of this processing, we apply automated scrubbing to text inputs before they are sent to these providers. The scrubber attempts to remove common categories of personal identifying information, including names, phone numbers, email addresses, postal addresses, ZIP codes, dates of birth, Social Security numbers, medical record numbers, and insurance identifiers.
You Are Responsible for What You Submit
Do not deliberately submit personal identifying information about yourself or any other person through the Services. By using the Services, you agree not to upload, paste, photograph, record, or otherwise transmit content that contains personally identifying information about yourself, family members, healthcare providers, or any third party where it is not strictly necessary for the health-information feature you are using.
Automated scrubbing is a best-effort safeguard, not a guarantee. The scrubber uses pattern-based detection that may fail to identify uncommon name spellings, foreign-language identifiers, hand-written information in images, audio that has been heavily fragmented, or identifiers embedded in unusual formats. You acknowledge that any personal identifying information you choose to submit may reach our third-party AI service providers despite our scrubbing efforts, and you accept that risk.
Bubo Health is not liable for any disclosure, processing, or further use of personal identifying information that you voluntarily submit to the Services in violation of this section. If you accidentally submit such information, you may request deletion of your account data through the in-app account deletion feature or by contacting privacy@bubo.health.
4. Visit Recorder — Recording Consent and Legal Requirements
Recording Laws Vary — You Are Responsible for Compliance
Recording healthcare conversations may be subject to federal and state wiretapping, eavesdropping, and privacy laws. You are solely responsible for ensuring that any recording you make using the Visit Recorder complies with all applicable laws in your jurisdiction and the jurisdiction of the person being recorded.
4.1 Federal Law
The federal Wiretap Act (18 U.S.C. § 2511) generally permits recording of conversations when at least one party to the conversation (such as yourself) has consented to the recording (“one-party consent”). However, federal law establishes a minimum standard only — state laws may impose stricter requirements.
4.2 All-Party Consent States
Several U.S. states require the consent of all parties to a conversation before it may be lawfully recorded. If you are located in, or your healthcare provider is located in, one of these states, you must obtain the explicit, informed consent of your healthcare provider before activating the Visit Recorder. As of the date of these Terms, states with all-party or two-party consent requirements include:
- California
- Connecticut
- Delaware
- Florida
- Illinois
- Maryland
- Massachusetts
- Michigan
- Montana
- Nevada
- New Hampshire
- Oregon
- Pennsylvania
- Washington
This list is provided for informational purposes only. Recording laws change, vary in judicial interpretation, and may apply based on the location of either party to the conversation. This list may not be exhaustive. Consult a licensed attorney in your jurisdiction before recording if you have any uncertainty about the lawfulness of recording a particular conversation.
4.3 Our Strong Recommendation
Regardless of the legal requirements in your state, we strongly recommend that you always inform your healthcare provider that you intend to record the visit before activating the Visit Recorder. Transparency about recording fosters trust in your care relationship and is the ethical standard we encourage all users to follow. Many healthcare providers welcome visit recording as a tool for patient engagement and recall.
4.4 Your Representations and Responsibilities
By activating the Visit Recorder, you represent and warrant that:
- You have obtained all legally required consents from all parties to any conversation you record.
- You have determined in good faith that recording is lawful under the laws applicable to your situation, including the laws of your state and the state where your healthcare provider is located.
- You accept full legal responsibility for any recording you make using the Visit Recorder feature.
Bubo Health accepts no liability for any recording made in violation of applicable law. You agree to indemnify and hold harmless Bubo Health from any and all claims, damages, fines, or penalties arising from your unlawful or unauthorized use of the Visit Recorder.
4.5 Audio Processing
Audio recorded through the Visit Recorder is transmitted to a third-party AI transcription service for processing. Raw audio files are not retained after transcription is complete. The resulting text transcript is stored in your account. See our Privacy Policy for complete details.
5. Health Data Accuracy and Limitations
The usefulness of Bubo Health depends heavily on the accuracy of the health information you enter. You are solely responsible for the accuracy, completeness, and timeliness of all health information you record in the app, including medications, dosages, allergies, conditions, symptoms, and other personal health data.
Bubo Health is not an official medical record system. Records stored in Bubo Health are personal health notes and organizational tools for your own reference. They are not equivalent to, and should not be treated as a substitute for, official health records maintained by your healthcare providers, hospitals, pharmacies, or health systems. Do not rely solely on Bubo Health records in clinical settings. Always verify critical health information — particularly medications, allergies, and active diagnoses — directly with your official healthcare providers.
Health records retrieved from external healthcare systems through integrations you authorize reflect data held by those external systems and are subject to their accuracy, completeness, and timeliness. Bubo Health displays externally retrieved data as received and does not independently verify or validate it.
6. Electronic Health Record Integration
Bubo Health offers the ability to connect to your electronic health records through authorized integrations with participating healthcare organizations. By authorizing an EHR integration:
- You authorize Bubo Health to access your health records from connected healthcare organizations using secure, industry-standard patient authorization protocols, on a read-only basis.
- You acknowledge that this authorization is voluntary and may be revoked at any time by disconnecting the integration from the Settings screen in the app.
- You understand that Bubo Health does not write to, modify, or delete records in any external health system.
- You represent that you are the patient or a legally authorized representative of the patient whose records you are accessing.
- You acknowledge that availability of EHR integrations depends on your healthcare organization's participation in applicable health record access programs and may change without notice.
7. No Telemedicine Services
Bubo Health is not a telemedicine or telehealth service. We do not provide real-time clinical consultations, connect you with licensed healthcare providers for medical appointments, or facilitate any form of direct clinical care. The AI chat and health information features in Bubo Health are informational tools only. They do not constitute a clinical consultation, and no professional clinical relationship is established through your use of these features.
If you need to speak with a healthcare provider, please contact your physician's office, use a licensed and regulated telemedicine service, visit an urgent care center, or go to an emergency room. In an emergency, call 911.
8. User Accounts and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete information when creating and maintaining your account.
- Keep your password secure and not share your credentials with others.
- Notify us immediately at support@bubo.health if you suspect unauthorized access to or use of your account.
- Use the Services only for lawful personal health management purposes.
- Not attempt to reverse engineer, decompile, hack, scrape, or misuse the Services or our infrastructure.
- Not use the Services on behalf of another person without that person's explicit authorization or your appropriate legal authority (such as a healthcare power of attorney, guardian, or legal representative).
9. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law, regulation, or these Terms.
- Record conversations without obtaining all legally required consents.
- Deliberately upload, paste, photograph, record, or otherwise transmit personal identifying information about yourself or any other person through the Services where it is not strictly necessary for the feature you are using (see Section 3.5).
- Gain unauthorized access to our systems, accounts belonging to other users, or third-party systems.
- Upload or transmit malicious software, viruses, or any code designed to interfere with the Services.
- Use automated tools, bots, or scripts to access or extract data from the Services without our written consent.
- Misrepresent your identity, affiliation, or the nature of your use.
- Overburden, impair, or disrupt our infrastructure or third-party systems connected to the Services.
- Harass, defame, or harm any person through the Services.
10. Intellectual Property
The Bubo Health application, its design, user interface, logos, original content, and underlying technology are the intellectual property of Bubo Health and are protected by copyright, trademark, and other applicable laws. You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own personal, non-commercial health management purposes. You may not copy, modify, distribute, sell, sublicense, or create derivative works of the Services or any part thereof.
You retain ownership of the personal health data you enter into Bubo Health. By using the Services, you grant us a limited license to process and store your data as necessary to provide the Services to you, consistent with our Privacy Policy.
11. Subscriptions and Fees
Bubo Health may offer free and paid subscription tiers. Current pricing, available features per tier, and billing cycles are described within the app and on our website. All payments for in-app purchases and subscriptions are processed through Apple's App Store payment system, subject to Apple's terms. We do not directly collect or store your payment card information.
Paid subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You may cancel at any time through your device's App Store account settings. Except as required by applicable law or Apple's refund policies, subscription fees are non-refundable for partially used billing periods.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BUBO HEALTH EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS;
- WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, CURRENTNESS, OR CLINICAL SUITABILITY OF ANY CONTENT PROVIDED THROUGH THE SERVICES, INCLUDING AI-GENERATED CONTENT, MEDICATION INFORMATION, DRUG INTERACTION ASSESSMENTS, LAB RESULT INTERPRETATIONS, NUTRITIONAL ANALYSIS, OR VISIT TRANSCRIPTIONS;
- WARRANTIES THAT DATA TRANSMITTED THROUGH OR STORED BY THE SERVICES WILL BE SECURE OR FREE FROM UNAUTHORIZED ACCESS AT ALL TIMES.
YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF THE SERVICES AND WITH ANY DECISIONS YOU MAKE BASED ON INFORMATION PROVIDED BY OR THROUGH THE SERVICES.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUBO HEALTH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND;
- LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, DATA, OR GOODWILL;
- PERSONAL INJURY, MEDICAL HARM, BODILY INJURY, ADVERSE HEALTH OUTCOME, OR DEATH ARISING FROM RELIANCE ON INFORMATION PROVIDED BY THE SERVICES OR ANY AI FEATURE;
- DAMAGES ARISING FROM MEDICATION DECISIONS, DRUG INTERACTION ERRORS, TREATMENT DECISIONS, OR OTHER HEALTH-RELATED DECISIONS MADE IN RELIANCE ON CONTENT FROM THE SERVICES;
- DAMAGES ARISING FROM UNAUTHORIZED RECORDINGS OR VIOLATIONS OF APPLICABLE RECORDING, WIRETAPPING, OR PRIVACY LAWS;
- DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO, ALTERATION OF, OR DISCLOSURE OF YOUR DATA;
- DAMAGES ARISING FROM INTERRUPTION, SUSPENSION, OR CESSATION OF ANY PART OF THE SERVICES.
IN NO EVENT SHALL BUBO HEALTH'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER OR IN CONNECTION WITH THESE TERMS EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO BUBO HEALTH IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR FORMS OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LAWFULLY LIMITED.
The limitations in this section reflect the mutual agreement of the parties that the allocation of risk is reasonable and appropriate, given the personal health management nature of the Services, the inherent complexity and variability of health information, and the free or low-cost nature of the Services. These limitations are a fundamental element of the basis of the bargain between you and Bubo Health, without which we could not provide the Services at current pricing.
14. Indemnification
You agree to indemnify, defend, and hold harmless Bubo Health and its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or inability to use the Services; (b) your violation of these Terms or any applicable law; (c) your recording of conversations without legally required consent; (d) any medical, health, or other decisions you make based on information from the Services; (e) any third-party claims arising from your use of the Services; or (f) any inaccurate health information you enter into the Services that affects AI responses or other outputs.
15. Dispute Resolution — Binding Arbitration and Class Action Waiver
15.1 Informal Resolution First
Before initiating any formal dispute process, you agree to contact us at legal@bubo.health and provide us with 30 days to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services informally.
15.2 Binding Individual Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Services — including any question of arbitrability — shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted in Tennessee, or virtually if both parties agree. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.
15.3 Class Action Waiver
YOU AND BUBO HEALTH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED PROCEEDING, OR REPRESENTATIVE ACTION.Unless both parties expressly agree in writing, no arbitrator may consolidate more than one person's claims or preside over any form of class, collective, or representative proceeding.
15.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidentiality obligations. Either party may also bring an individual claim in small claims court if the dispute qualifies under that court's jurisdictional rules.
15.5 Arbitration Opt-Out
You may opt out of the binding arbitration provision within 30 days of first accepting these Terms by sending written notice to legal@bubo.health. Your opt-out notice must include your name, the email address associated with your account, and a clear statement that you are opting out of arbitration. Opting out does not affect any other provision of these Terms.
16. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of laws principles. For any disputes not subject to arbitration under Section 15, you consent to the exclusive personal jurisdiction of the state and federal courts located in Tennessee.
17. Termination
You may stop using the Services and delete your account at any time. We reserve the right to suspend or terminate your access to the Services, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in harmful or fraudulent activity, or for any other reason we deem necessary to protect the integrity and safety of the Services or our users.
Upon termination of your account for any reason, your right to access and use the Services ceases immediately. Sections of these Terms that by their nature should survive termination — including but not limited to Sections 3 (AI Disclaimers), 12 (Disclaimer of Warranties), 13 (Limitation of Liability), 14 (Indemnification), 15 (Dispute Resolution), and 19 (General Provisions) — shall survive.
18. Changes to These Terms
We may modify these Terms from time to time. When we make material changes, we will update the “Last Updated” date above and notify you by email or in-app notification before the changes take effect. Your continued use of the Services after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services and delete your account.
19. General Provisions
19.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bubo Health with respect to your use of the Services and supersede all prior or contemporaneous understandings, agreements, representations, or warranties, whether written or oral, relating to the Services.
19.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.
19.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of a specific term must be in writing and signed by an authorized representative of Bubo Health.
19.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely, including in connection with a merger, acquisition, or sale of assets, subject to the notification obligations described in our Privacy Policy.
19.5 Force Majeure
Bubo Health shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemic, government action, infrastructure failures, or third-party service outages.
19.6 No Third-Party Beneficiaries
These Terms are for the benefit of you and Bubo Health only. They do not create any third-party beneficiary rights.
